General Terms and Conditions of Business

The Company: Elite Möbel

1. SCOPE OF TERMS

All services, offers, and deliveries by Elite Möbel are subject exclusively to these terms and conditions. Any conflicting or differing terms proposed by the customer are hereby rejected. Modifications, amendments, or supplementary agreements are only valid if confirmed in writing.

2. RENTAL ITEMS

All furniture, equipment, and accessories specified in the order confirmation are considered rental items. The renter is granted these items for standard use.

3. RENTAL DURATION

The rental items are provided strictly for the agreed-upon purpose and period. If the renter exceeds the agreed rental period, the lessor reserves the right to charge additional rental fees accordingly. Further claims for damages by the lessor remain unaffected.

4. PRICING

The lessor’s offers are non-binding and only become valid upon written confirmation. All rental prices are net amounts, payable without deductions, and subject to applicable statutory VAT. Unless otherwise agreed, the following services are not included in the rental price and will be charged separately:

  • Delivery
  • Assembly and disassembly
  • Retrieval of rental furniture

5. DELIVERY AND RETURN

Rental items will be delivered and made available before the event begins unless otherwise agreed. Collection will take place promptly after the event concludes. The renter must ensure that all rental items are ready for pickup. If the renter causes delays in collection, the lessor is entitled to charge for additional costs incurred. Customers collecting items themselves must use appropriate enclosed transport vehicles. In the case of delayed payment, the lessor reserves the right to withhold delivery or reclaim delivered rental items prematurely.

6. RESPONSIBILITY & USAGE

The renter is responsible for any damage to or loss of rental items and may be charged for repair costs or the replacement value, as long as they do not exceed the original item value. The lessor retains the right to claim further damages. The renter assumes responsibility for the items upon receipt and remains liable until their return. For exhibition rentals, liability begins when items are delivered to the exhibition stand and ends upon collection, even if the stand is unattended. Unless otherwise agreed, liability ceases 24 hours after the event concludes. The lessor is not liable for damages or injuries resulting from the use of rental items, except in cases of intentional misconduct or gross negligence.

7. INSURANCE

Rental items are not insured. The renter is responsible for ensuring proper theft protection and must provide immediate proof of insurance upon request.

8. CANCELLATION POLICY

Orders may be canceled up to 14 days before the event or scheduled delivery date. For cancellations after this period, the full rental fee will be due. However, if the rental items can be reallocated, the customer will only be responsible for costs incurred up to that point. If the lessor is unable to provide an equivalent or better replacement, the renter has the right to cancel based on justified complaints.

9. LEGAL JURISDICTION

The place of performance for both parties is the registered headquarters of the lessor. If the renter is a business entity, legal jurisdiction will also be based at the lessor’s headquarters. German law applies, including for transactions involving foreign accounts.
